Terms and Conditions USM Construction LLC 5734 W Michigan St, Tucson, AZ 85735 Phone: (520) 665-9950Last updated: 1/1/2025 These Terms and Conditions ("Terms") govern all services provided by USM Construction LLC ("USM," "Company," "we," or "our") to its clients ("Client" or "you"). By accepting an estimate, signing a contract, or allowing work to commence, you agree to be bound by the following terms: 1. Scope of WorkAll work performed will be outlined in a written estimate or agreement. Any changes to the original scope must be approved in writing by both parties and may result in additional charges. 2. Estimates and PricingEstimates are valid for 30 days and are subject to change based on material cost fluctuations or site conditions. Final pricing may vary if additional work is required due to unforeseen circumstances. 3. Payment TermsPayment is due as outlined in the proposal or invoice. A deposit may be required to begin work. Remaining balances are typically due upon completion of work unless otherwise agreed. A late fee of 2% per month may be applied to overdue accounts. 4. Permits and RegulationsIt is the Client’s responsibility to secure and pay for any necessary permits unless explicitly stated otherwise. USM will perform work in accordance with applicable local, state, and federal laws and building codes. 5. Site ConditionsClient agrees to provide safe, clear, and accessible working conditions. USM is not responsible for delays or additional costs caused by site obstructions, hazardous materials, or unreported underground utilities. 6. WarrantiesUSM provides a limited workmanship warranty of 1 year from the date of completion. This warranty does not cover cracking, discoloration, or damage caused by natural wear, misuse, settlement, or external factors beyond our control. 7. DelaysUSM is not liable for delays due to weather, labor shortages, supply chain disruptions, or other events beyond our reasonable control. 8. Limitation of LiabilityUSM shall not be liable for incidental, indirect, or consequential damages. Our total liability is limited to the amount paid by the Client for the specific project. 9. Cancellations and RefundsCancellations must be made in writing. Deposits are non-refundable once work has commenced or materials have been ordered. 10. Dispute ResolutionAny disputes arising out of or relating to these Terms shall be resolved first through good-faith negotiation. If unresolved, disputes will be settled by arbitration in Pima County, Arizona, in accordance with the rules of the American Arbitration Association. 11. Governing LawThese Terms shall be governed by the laws of the State of Arizona. 12.
